Safety Violation Claims (VSSR)

Workplace Equipment and Safety Hazard Injuries

Toledo, Ohio, Workers' Compensation and Lawyer

When you are injured at work, you are covered by workers' compensation. If your accident or injury stemmed from defective equipment, unsafe working conditions or an employer's failure to provide safety gear, you may be entitled to an additional monetary award.

The law firm of Borgstahl & Zychowicz, Ltd. will fight for all entitled workers' comp benefits, including punitive compensation for a Violation of Specific Safety Requirements (VSSR) as set forth in the Ohio Administrative Code §4121.47.

Does Your Work Injury Meet the VSSR Criteria?
Call us at 800-644-7911 for a free case evaluation and aggressive pursuit of your maximum work injury compensation.

We have secured VSSR awards on behalf of construction workers, industrial plant employees, factory and warehouse workers, utilities and maintenance personnel, and clients in a broad range of occupations governed by the Specific Safety Requirements. Our attorney will use his experience to prove that the employer had a statutory duty and failed to protect you from foreseeable harm.

Examples of VSSR claims include:

  • Ladders or scaffolding that fail
  • A trench collapse
  • Inadequate fall protection equipment
  • Removal of safety guards on conveyor belts, saws or presses
  • Inadequate lockdown or tag-out procedures on machinery, such as when a worker gets a hand or clothing caught in the apparatus

Experienced Representation in Safety Violation Cases

VSSR claims are investigated by a special unit of the Ohio Bureau of Workers' Compensation, and eventually argued in a merit hearing before the Industrial Commission if the employer and injured worker do not reach a settlement after receiving the BWC's report. A VSSR award is paid as a percentage of the maximum weekly wage benefit, above and beyond other workers' comp benefits.

Attorney Gene Borgstahl brings 25 years of experience in both Ohio and Michigan workers' compensation litigation. Mr. Borgstahl uses his comprehensive knowledge to prove that the employer was non-compliant with a specific safety rule at the time of the accident, and he prepares to counter any claims by the employer that the victim violated safety requirements (such as not wearing a hard hat or safety harness).
